Terms of Service

1. Acceptance of Terms

By accessing or using SourcAuto ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. SourcAuto is operated by EEGIX, registered in Belgium as a Commanditaire Vennootschap (CommV) under the small-business VAT exemption scheme (franchise de base).

2. Description of Service

SourcAuto is a B2B SaaS platform that monitors European car marketplaces and sends alerts to car dealers and brokers when listings matching their criteria appear. The Service aggregates publicly available listing data for informational purposes only.

3. Free Trial

New accounts are granted a 7-day free trial with access to Starter-tier features. At the end of the trial period, access to the Service is suspended until a paid subscription is activated. Trial usage is subject to these Terms.

4. Subscriptions and Billing

Paid subscriptions are billed monthly or annually. All payments are processed by Paddle.com, acting as Merchant of Record. Paddle handles invoicing, VAT compliance, and payment processing in accordance with applicable EU regulations. Prices are displayed inclusive or exclusive of VAT depending on your billing country; Paddle will confirm the applicable tax at checkout.

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period. See our Refund Policy for details on the refund window and how to request a refund.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to violate any applicable laws, infringe on third-party rights, or interfere with the operation of the Service or third-party platforms we monitor.

6. Intellectual Property

All software, design, and documentation of SourcAuto are the exclusive property of the operator. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your subscription period.

7. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranty of any kind. Listing data is sourced from third-party marketplaces and may be incomplete, inaccurate, or delayed. SourcAuto is not liable for any business decisions made on the basis of data provided by the Service. To the extent permitted by law, our total liability is limited to the amount you paid in the 3 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. You may delete your account at any time from your account settings.

9. Governing Law

These Terms are governed by the laws of Belgium. Any disputes shall be subject to the exclusive jurisdiction of the courts of Belgium.

10. Affiliate Programme

SourcAuto operates an invite-only affiliate programme that allows approved partners ("Affiliates") to earn commissions by referring new paying subscribers.

10.1 Eligibility and Enrolment

Participation requires individual approval by SourcAuto. Affiliates receive a unique referral link and a 6-digit code. Affiliates may not refer themselves or create accounts for the purpose of generating commissions.

10.2 Commission Structure

Commissions are calculated as a percentage of the net subscription amount (excluding VAT and Paddle processing fees) for each active referred subscriber during a calendar month:

• Starter tier (1–4 active referrals): 10%
• Growth tier (5–14 active referrals): 15%
• Partner tier (15+ active referrals): 20%

Individual commission rates may be negotiated and fixed in writing. Commissions accrue in a monthly ledger and are marked "pending" until reviewed and approved by SourcAuto.

10.3 Attribution and Cookie Window

Attribution is tracked via a 90-day cookie. A referred visitor who registers within 90 days of clicking an affiliate link is attributed to that Affiliate, provided they subsequently convert to a paid subscription. Only the most recent affiliate referral is attributed in the event of multiple affiliate clicks. Re-subscriptions within 6 months of churn retain the original attribution.

10.4 Payouts

Commissions become eligible for payout once approved by SourcAuto. Payouts are processed manually or via supported payment methods (Wise bank transfer, PayPal) on a monthly basis, subject to a minimum payout threshold of €25. Affiliates are responsible for providing accurate payout details. SourcAuto is not liable for payments sent to incorrect accounts provided by the Affiliate.

10.5 Taxes

Affiliate commissions constitute income. Affiliates are solely responsible for declaring commissions to the relevant tax authorities in their jurisdiction and for paying any applicable taxes, social contributions, or VAT. SourcAuto does not withhold tax on commission payments and does not issue income tax certificates.

10.6 Prohibited Practices

The following practices will result in immediate suspension and forfeiture of all pending and future commissions:

• Self-referral or referring fictitious persons
• Paying or incentivising others to sign up without their genuine intent to use the Service
• Making misleading or false claims about SourcAuto in promotional materials
• Using spam, unsolicited bulk email, or black-hat SEO techniques
• Artificially inflating click counts or other metrics
• Bidding on SourcAuto branded keywords in paid search without prior written approval

10.7 Programme Changes and Termination

SourcAuto reserves the right to modify commission rates, tier thresholds, or payout terms with 30 days' written notice to active Affiliates. We may terminate an affiliate relationship at any time for violation of these Terms, with immediate forfeiture of any unpaid commissions arising from fraudulent activity. In cases of legitimate termination for other reasons, accrued approved commissions will be paid out in the next regular cycle.
